CANNONDALE BIKE DAY CHALLENGE

Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. General
   1. Cycling Sports Group Europe B.V., Geeresteinselaan 57, 3931 JB Woudenberg, The Netherlands (the "Organizer") organizes a promotional prize draw for Strava users to challenge themselves to complete 100km in 10 days in recognition of World Bicycle Day. An eligible participant ("Participant") has the chance to win various prizes by completing the challenge posted at https://www.strava.com/challenges/cannondale-nothing-is-impassable (“Challenge Page”) and completing the online entry form (the "Competition").

   These General Terms and Conditions (the "Terms") are provided to potential Participants prior to their participation in the Competition. By participating, the Participant confirms to have read, and agrees to accept and be bound by, these Terms.  These Terms can also be found here: https://www.cannondale.com/en/giveaways/bike-day-strava-challenge-0622 (the “Website”).

2. The Competition
   1. To participate in the Competition and to be eligible for the prize(s), the Participant must log into their Strava account, sign up for and complete the challenge described on the Challenge Page during the Competition Period, and complete the online entry form on the Website, including first and last name, valid email address, and country of residence. To obtain an entry without completing the challenge, complete the Competition entry form found at the Website.
   2. Participation is not dependent on completing the challenge and you have the same chance of winning in any case.
   3. No entry fee applies to participating in the Competition.
   4. The starting date of the Competition is 3 June 2022 at 00:00 and the closing date of the Competition is 24 June 2022 at 23:59 in the Participant’s local time (the “Competition Period”).
3. Participants
   1. The Competition is open to Strava users who are legal residents of France, Germany, Austria, Switzerland, Netherlands, United Kingdom, United States (excluding New York and Florida), or Canada (excluding Quebec) and have reached the age of majority in their jurisdiction of residence.
   2. Excluded from participation are:
      1. permanent and temporary employees of the Organizer;
      2. permanent and temporary employees of third parties who assist the Organizer in the organization of the Competition; and
      3. first-line family members (i.e. parents, children, and siblings) of the employees referred to under 3.2.1. and 3.2.2.
   3. The Organizer is entitled to exclude the Participant from (further) participation in the Competition if their entry appears to be fraudulent or unlawfully influenced, or the Participant has violated these Terms.
   4. Participants are allowed to participate once. This means that multiple entries of one Participant will not count and that the Participant will be excluded from participation in case of any attempt of multiple entries.
   5. The Participant will provide the Organizer with all necessary accurate and correct (personal) data in the context of the Competition.
4. Winners
   1. A total of one (1) winner(s) will be picked at random from among all eligible entries received during the Competition Period. The designation of the winner(s) of the prize(s) takes place in an impartial manner.
   2. The results of the Competition will be announced within three months after the end of the Competition Period. The winner(s) will be notified on or about 30 June 2022 by the Organizer by email about when and where the prize can be collected and/or will be delivered. If the winner cannot be contacted within two (2) days after the notification of the Organizer, the Organizer reserves the right to withdraw the winner and the Organizer will randomly pick a replacement winner.
   3. Participants may request the Organizer to provide an overview of the prizes that have been awarded by the Organizer in the context of this Competition.
5. Prizes
   1. The first prize (one (1) prize(s) available) includes one (1) Cannondale® Topstone Carbon 2 Lefty in color Gold Dust. Size to be selected by winner, subject to availability. The prize has an estimated value of €5199 (VAT included).
   2. The prize(s) is/are as stated above and no cash or other alternatives will be offered to the winner(s). The prizes are not transferable. Prizes are subject to availability and the Organizer reserves the right to substitute any prize with another prize of equivalent nature and economic value without giving prior notice.
6. Responsibility and liability[1]
   1. To the fullest extent permitted under applicable law, the Organizer is not liable for any direct and/or indirect damages, consequential damages, lost profits, or other purely pecuniary loss suffered by a Participant in connection with or resulting from their participation in the Competition or in the context of winning the prizes, except for cases of gross negligence or intent.
   2. To the fullest extent permitted under applicable law, the Organizer is not liable for (i) entries that for any reason have not been received by the Organizer, (ii) malfunctions in IT systems that result in limited, delayed or loss of entries, (iii) damage suffered by any Participant as a result of typing errors, or (iv) inaccurate prize details supplied to any Participant by any third party connected to this Competition.
   3. The limitation of liability as set out in paragraphs 6.1 and 6.2 also applies to the Organizer's legal representatives and agents.
7. Privacy
   1. The Organizer shall process the personal data provided in the context of the Competition in accordance with its privacy statement: https://bit.ly/3s5ZjZ5.
8. Complaints
   1. If the Participant has any questions, comments and/or complaints about the Competition the Participant can contact [email protected].
   2. The Organizer will respond to any request as quickly as reasonably possible.
   3. If the Participant resides in the Netherlands and believes that the request has not been adequately dealt with, a written complaint can be submitted to the Netherlands Gambling Authority, Postbus 298, 2501 CG The Hague.
9. Gambling tax
   1. If any gambling tax applies to any of the prize as set out above, such costs shall be borne entirely by the Organizer.
10. Final remarks
    1. The Organizers decisions concerning the Competition are final; no correspondence will be entered into on these decisions.
    2. If any provision in these Terms is invalid or unenforceable, the Organizer will replace such provision with a provision that aligns with the purpose and scope of the invalid or unenforceable provision as closely as possible.
    3. The Organizer shall at any time have the right to change or modify the Terms, if otherwise, for technical, legal or other reasons, or if a proper execution of the Competition can no longer be ensured, but only provided that no change will disadvantages a Participant. The Organizer shall inform the Participant prior to such changes becoming effective.
    4. The Organizer may cancel the Competition or amend the Terms without prior notice if an event outside its control occurs that stops, or substantially limits, it from running the Competition as planned, or if running the Competition would or may put it in breach of applicable laws or regulations.
    5. To the extent the Competition should be qualified as a promotional game of chance under Dutch law, the Competition is compliant with the Gedragscode promotionele kansspelen.
11. country specific provisions
    1. Section 6 of these Terms does not apply if the Participant resides in Germany. If the Participant resides in Germany, the following applies:
       1. Unless otherwise set out in this section, the Organizer shall be liable for a breach of contractual and non-contractual duties as provided for by statute.
       2. The Organizer has unlimited liability – for whatever reason – for compensation for losses based on wilful (vorsätzlich) or grossly negligent (grob fahrlässig) breach of duty by the Organizer or by any of the Organizer's legal representatives or vicarious agents.
       3. In the event of a merely slightly or ordinarily negligent (einfach oder leicht fahrlässig) breach of duty by the Organizer or one of the Organizer's legal representatives or vicarious agents, the Organizer shall (subject to a milder level of liability pursuant to statute) be liable only (i) – but without limit – for resultant losses arising from injury to life, limb or health; (ii) for losses arising from a breach of material contractual duties. Material contractual duties are those duties that are material to proper performance of the contract and on whose fulfilment the customer generally relies or is entitled to rely. In this case, however, the amount of the Organizer's liability is limited to losses which are typical of this type of contract and which were foreseeable at the time the contract was concluded.
       4. The liability limitations pursuant to paragraph 11.1.3 do not apply where the Organizer has maliciously failed to disclose a defect or where we have assumed a warranty for the Competition. This shall have no effect on any mandatory statutory liability, in particular under the German Product Liability Act (Produkthaftungsgesetz).
       5. Where the Organizer's liability is excluded or limited under the above provisions, this also applies to the personal liability of the Organizer's legal representatives, employees, staff and other vicarious agents.
    2. If the Participant resides in Austria, nothing in section 6 shall exclude or limit in any way the Organizer’s liability for death or personal injury.
    3. Any potential winner residing in Canada must answer a time-limited mathematical skill-testing question without assistance of any kind. Failure to answer skill-testing question correctly in the time provided will result in disqualification and selection of an alternate winner, at Organizer’s sole discretion.
